Terms of Service

1. Acceptance of Terms

By accessing or using the TypoPet mobile application ("Service"), operated by BlueTag ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Definitions

  • "Service" means the TypoPet mobile application, including all features, content, and services offered.
  • "User" means any person who accesses or uses the Service.
  • "Account" means the registered account created by a User to access the Service.
  • "Content" means text, images, pixel art, pets, comments, reviews, and any other materials uploaded or created by Users.
  • "Marketplace" means the in-app platform where Users can buy and sell pixel art pets.
  • "Subscription" means the paid subscription plans (BASIC, PREMIUM, PRO) offered by the Service.

3. Eligibility

  • You must be at least 13 years old (or 16 in the EU) to use the Service.
  • If you are under 18, you must have parental consent to use the Service.
  • By creating an Account, you represent that all information you provide is accurate and complete.

4. Account Registration and Security

  • Registration: You may register using email/password or Google Sign-In.
  • Single Device Login: For security, only one device can be logged in at a time. Logging in on a new device will automatically log out the previous session.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials.
  • Prohibited: Sharing your account, creating multiple accounts, or using another person's account without permission.

5. Service Features

  • Typing Activity Tracking: Monitor your typing across apps (requires Android Accessibility Service permission)
  • Virtual Pet System: Grow virtual pets based on your typing activity
  • Pet Overlay System: Display multiple pets on your screen (slot-based system)
  • Friend Pet Feature: Follow friends and view their pets with real-time synchronization
  • Pixel Art Editor: Create custom pixel art pets
  • Marketplace: Buy and sell user-created pets
  • Statistics Dashboard: View your typing statistics and analytics

6. Subscription Plans and Pet Overlay Slots

FREE Tier (Default)

  • Cost: Free
  • Pet Overlay Slots: 1 slot (own pets only, friend pets not available)
  • Features: Basic typing tracking, single pet display, marketplace access
  • Ads: Supported by ads

BASIC Tier

  • Cost: $1.99/month or $19.99/year (save 16%)
  • Pet Overlay Slots: 3 slots (any combination of own pets + friend pets)
  • Features: Multiple pets display, friend pet overlay, real-time sync, custom pet settings
  • Ads: Supported by ads

PREMIUM Tier

  • Cost: $3.99/month or $39.99/year (save 16%)
  • Pet Overlay Slots: 6 slots (any combination of own pets + friend pets)
  • Features: All BASIC features + ad-free experience
  • Ads: Ad-free

PRO Tier

  • Cost: $6.99/month or $69.99/year (save 17%)
  • Pet Overlay Slots: 10 slots (any combination of own pets + friend pets)
  • Features: All PREMIUM features + priority support
  • Ads: Ad-free

Slot System Explanation

  • Each slot can hold either an own pet or a friend pet (user's choice)
  • Example: BASIC user (3 slots) can display 2 own pets + 1 friend pet, or 3 own pets + 0 friend pets
  • Friend pets require BASIC tier or higher (not available on FREE tier)
  • Attempting to add more pets than your slot limit will prompt an upgrade dialog

7. Payment and Billing

  • Payment Processing: All payments are processed through Google Play Billing.
  • Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the next billing date.
  • Cancellation: You can cancel your subscription anytime via Google Play settings.
  • Price Changes: We reserve the right to change subscription prices with 30 days notice.
  • Taxes: Prices do not include applicable taxes, which will be added at checkout.

8. Refund Policy

  • Google Play Policy: Refunds are subject to Google Play's refund policy.
  • Service Outages: If the Service is unavailable for more than 24 hours due to our fault, contact us for a prorated refund.
  • Digital Content: Marketplace purchases (pixel art pets) are non-refundable after download or use.
  • Subscription Refunds: Generally non-refundable, but exceptions may be made for service failures.

9. User Conduct and Prohibited Activities

You agree NOT to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights (e.g., uploading copyrighted pixel art without permission)
  • Upload offensive, abusive, or inappropriate content
  • Harass, threaten, or impersonate other users
  • Use bots, scripts, or automation to manipulate typing counts or game systems
  • Reverse-engineer, decompile, or hack the app
  • Resell or redistribute Service access or content
  • Spam, advertise, or promote third-party services without permission
  • Create multiple accounts to abuse free trials or promotions
  • Upload malware, viruses, or harmful code

10. Intellectual Property Rights

A. Company-Owned Content

  • The TypoPet app, logo, branding, and default pets are owned by BlueTag.
  • You may not copy, modify, or redistribute our proprietary content.

B. User-Generated Content

  • Ownership: You retain copyright to pixel art and content you create.
  • License to Us: By uploading content, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to:
    • Use, display, reproduce, and distribute your content within the Service
    • Promote your content in our marketing materials, advertisements, and promotional videos
    • Showcase your content on our website, social media, app store listings, and advertising campaigns
    • Modify or adapt your content for promotional purposes (with credit to creator when reasonably possible)
  • Attribution: We will make reasonable efforts to credit creators when featuring content in promotional materials.
  • Opt-Out: If you do not wish your content to be used in promotional materials, contact us at hsb5975@naver.com and we will remove it from future marketing (existing campaigns may continue until completion).
  • Marketplace Sales: When you sell a pet in the Marketplace, we take a 30% commission. You retain 70% of the sale price.
  • Content Responsibility: You are solely responsible for ensuring your content does not infringe on third-party rights.

C. Copyright Infringement (DMCA)

If you believe your copyright has been infringed, contact us at hsb5975@naver.com with:

  • Description of the copyrighted work
  • URL or location of the infringing content
  • Your contact information and signature
  • A statement that you have a good faith belief the use is unauthorized

We will investigate and remove infringing content as appropriate.

11. Android Accessibility Service

  • Purpose: We use Accessibility Service solely to count typing events (keystrokes) for the pet growth feature.
  • What We DO NOT Collect: We do not collect the actual text you type, passwords, or sensitive data.
  • Optional: Accessibility permission is optional. You can use the app without it (with manual typing count).
  • Privacy: See our Privacy Policy for details on data handling.

12. Service Availability and Modifications

  • Availability: We aim to provide 24/7 service but do not guarantee uninterrupted access.
  • Maintenance: We may temporarily suspend the Service for maintenance, updates, or technical issues.
  • Modifications: We reserve the right to modify, add, or remove features at any time with reasonable notice.
  • Discontinuation: We may discontinue the Service with 30 days notice. Active subscriptions will be refunded on a prorated basis.

13. Account Termination

A. By You

  • You may delete your account anytime via in-app settings.
  • Upon deletion, your personal data will be deleted (see Privacy Policy for retention exceptions).
  • Published marketplace content may remain available unless you request removal.

B. By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or abusive behavior
  • Fail to pay subscription fees
  • Use the Service in a way that harms us or other users

We will provide notice before termination unless immediate action is required for legal or security reasons.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

  • No warranty of uninterrupted or error-free operation
  • No warranty that the Service will meet your requirements
  • No warranty regarding third-party content accuracy
  • No warranty that typing counts will be 100% accurate

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are NOT liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the last 12 months (or $100, whichever is greater)
  • We are not responsible for user-generated content, third-party links, or data loss
  • For FREE tier users, our liability is limited to $100

16. Indemnification

You agree to indemnify and hold BlueTag harmless from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your infringement of third-party rights
  • Your user-generated content

17. Third-Party Services

  • The Service uses Google Firebase, Google Play Billing, and Google AdMob.
  • These services have their own terms and privacy policies, which you should review.
  • We are not responsible for third-party service interruptions or policy changes.

18. Changes to Terms

  • We may update these Terms from time to time.
  • Material changes will be notified via in-app notification or email at least 7 days before taking effect.
  • Continued use of the Service after changes constitutes acceptance.
  • If you do not agree to the changes, you must stop using the Service and delete your account.

19. Governing Law and Dispute Resolution

  • Governing Law: These Terms are governed by the laws of South Korea.
  • Jurisdiction: Disputes will be resolved in the courts of Seoul, South Korea.
  • Informal Resolution: Before filing a lawsuit, please contact us at hsb5975@naver.com to attempt informal resolution.
  • Arbitration: For international users, disputes may be resolved through binding arbitration.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BlueTag regarding the Service.

23. Language

These Terms are provided in English. If translated, the English version shall prevail in case of any conflict.
